What is ASNEF?

To begin, we will explain what exactly ASNEF is.

ASNEF, the National Association of Financial Establishments, is simply a file in which entities introduce their clients when they become delinquent. An example is if you do not pay the electricity, phone or loan bills, we will easily find ourselves among other defaulters who already appear on their lists. It is also possible that our name appears by mistake in the files of ASNEF or, even, that we have already disposed of the debt but still continue to appear. We are going to explain how you can check if your name is in lists like ASNEF.

Are there more delinquent listings other than ASNEF?

ASNEF is not the only file or list of defaulters that exists. Next we are going to give the name of other existing ones and some details of them.

  • EQUIFAX: headquartered in Atlanta (USA), it has been operating for almost a century, however its operations began in Spain since 1994 with the help of ASNEF, creating Equifax Ibérica SL. Being a market leader in credit information solutions. The File groups records from various sectors (publishers, insurers, telephone company, operators of energy services such as electricity, water, etc.)
  • EXPERIAN: is the list of delinquencies most consulted by banks in Spain. It is also known as the Badexcug file (Experian Closed Users Group Database). The Experian List (Badexcug) is managed by Experian Credit Bureau. The owner of the list is the Interbank Cooperation Center (CCI), an association of banks and savings banks created in 1985. In order to enter records in the list of the Experian file, it is necessary to be a member of the CCI association.
  • CIREX: It is the risk center of Experian and provides information about the solvency of credit applicants. It contains information on payment behaviors provided by lenders, to which in many cases data from other sources, such as courts, official gazettes or tax administrations, is added, including all this information in a single file or information system, and may contain negative or positive information
  • RAI: Unpaid Acceptances Registry is a registry of defaulters or defaulters file maintained by the Center for Interbank Cooperation and was created by banks, savings banks and credit unions. This file can only be consulted by entities associated with this Center. This list only shows debts of an amount greater than € 300.
  • CIRBE: (Bank of Spain’s Risk Information Center) is a list managed by the Bank of Spain where the credits, discount lines, loans, guarantees and other risks managed by financial entities, such as Savings Banks, Banks, Credit unions, etc.
  • FIJ: The FIJ or File of Judicial Incidents, is a database with the information provided by its own partners and by sources accessible to the public (Official Gazettes, Courts, etc.). In the file the debts with the Treasury, City Councils, General Treasury of Social Security, Traffic and other types of official debts appear.

According to Organic Law 5/1992, if your data becomes part of a list of defaulters, you must be informed by registered letter within a maximum period of 30 days. Within this period you can rectify or cancel the default and avoid becoming delinquent.

Often this notification does not arrive, either because it ends up lost or because it is sent to old, non-existent addresses … etc

Because of this, many people do not know that their data appears on the list of defaulters, and they are surprised to request a loan from a bank and it is rejected.

How can I know if I am in ASNEF

There are several ways to know if we appear on the ASNEF list. The first is by going to our trusted bank and requesting our advisor to provide us with such information. This process should be simple and free. Another option is to go to a company specialized in solvency and risk, which can provide us with that information and also help us manage the entire process to disappear from the list of defaulters.

If none of these options works for us, another simple way would be to go to your bank and make the intention of requesting a loan, without concluding it. By doing this, the entity will have to consult whether you are delinquent or not to fill out the file.

When can I request the deletion of my data from ASNEF?

You can request the deletion of your data as long as you meet one of the following conditions:

  • The debt has already been paid but you still appear as a debtor.
  • The debt that is claimed is more than 6 years old.
  • The debtor has not been notified by letter of the inclusion in the ASNEF.
  • The amount of the debt is not real.
  • The debt does not belong to you or your identity has been supplanted.
  • The claimed debt cannot be demonstrated.

Once our data has been removed from the ASNEF files, you cannot leave any indication that we were included in the file.
